Terms of Service

These Terms of Service ("Terms") govern your access to and use of AuditCore and related services
operated by TechnoNet Sdn Bhd (SSM 198901005373) ("TechnoNet", "we", "us").
By creating an account or using any part of the Service, you agree to be bound by these Terms.
If you are agreeing on behalf of an organisation, you represent that you have authority to bind
that organisation.
1. The Service
AuditCore provides two categories of compliance visibility tools:
1a. Website Compliance Check (Free)
An automated scan of a publicly accessible website URL against Malaysian regulatory requirements —
checking SSL configuration, security headers, privacy policy presence, email security (SPF/DMARC),
and publicly visible compliance signals. No account or payment is required. Results reflect the
publicly accessible surface of the website at the time of scanning.
1b. Codebase Compliance Audit (Paid)
A deep scan of a customer's source code, configuration files, and project artefacts against 222
checks across 15 Malaysian regulatory compliance profiles — including PDPA 2010 + Amendment 2024,
the National AI Office's AIGE guidelines and the proposed AI Governance Bill, Cyber Security Act 854, BNM RMiT, sector profiles (HR Tech, InsurTech,
PropTech, HealthData), and international frameworks (OWASP Top 10, ISO 27001, CIS Benchmarks, NIST CSF,
GDPR). Access requires a paid account and consumes scan credits according to your plan.
TechnoNet reserves the right to modify, suspend, or discontinue any part of the Service at any
time with reasonable notice to registered customers.
2. Accounts and Registration
To access paid features, you must create an account with a valid email address and a secure password.
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying TechnoNet immediately of any unauthorised use at [email protected]
Accounts are for a single organisation. You may not share account credentials across multiple
organisations or resell access to the Service without a written reseller agreement with TechnoNet.
3. Acceptable Use
You may use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Scan any system, website, or codebase that you do not own or do not have explicit written
authorisation to scan
- Use the Service to conduct, facilitate, or conceal any illegal activity
- Upload or submit content that contains malware, ransomware, or code designed to cause harm
- Attempt to circumvent scan credit limits, rate limits, or access controls
- Use automated means to scrape, extract, or republish scan results or platform content at scale
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure
- Reverse engineer, decompile, or attempt to extract the source code of the platform
TechnoNet may suspend or terminate any account found in violation of these terms without prior
notice. Illegal use will be reported to the relevant authorities.
4. Billing and Scan Credits
Paid plans are billed in advance on a monthly or annual basis. Scan credits are allocated according
to the plan selected. Key billing terms:
- Monthly plans: Renew automatically on the same date each month. Unused credits
in a monthly allowance do not roll over to the following month.
- Top-up packs: One-time purchases of additional scan credits. Top-up credits
never expire and stack with your monthly allowance.
- Free tier: The free website check does not consume credits and has no monthly
scan limit, subject to fair use. TechnoNet reserves the right to rate-limit free scans.
- Payment processing: All payments are processed by Stripe. Payment card details
are handled exclusively by Stripe and never transmitted to or stored by TechnoNet.
- Prices: Stated in Malaysian Ringgit (MYR) and exclusive of Sales
and Service Tax (SST). SST at the prevailing rate — currently 8% — is added at checkout
and shown as a separate line on your invoice. TechnoNet Sdn Bhd is an SST-registered service
provider — SST registration no. B16-1808-31025139. TechnoNet reserves the right to adjust prices with 30 days' notice to existing
subscribers; a change in the statutory SST rate takes effect on its gazetted date and is not a
price adjustment for the purposes of that notice.
5. Refund Policy
TechnoNet operates a fair-use refund policy:
- Monthly subscriptions: No refunds for partial months. You may cancel at any
time; cancellation takes effect at the end of the current billing period, after which your account
reverts to the free tier.
- Top-up packs: Refundable within 7 days of purchase if fewer than 10% of the
purchased credits have been consumed. Requests to [email protected].
- Service outage: If the Service is unavailable for more than 24 consecutive
hours due to TechnoNet's fault, affected customers are entitled to a pro-rated credit for the
outage period. This does not apply to outages caused by third-party providers, scheduled maintenance,
or force majeure events.
- Disputed charges: If you believe a charge was made in error, contact us within
30 days at [email protected].
6. Intellectual Property
Platform IP: AuditCore, its compliance check registry (15 profiles, 222 checks),
all AI models, report templates, and platform code are the intellectual property of TechnoNet Sdn Bhd.
Nothing in these Terms grants you any right, title, or licence in the platform beyond the limited
right to use the Service as described herein.
Your data: You retain full ownership of all source code, configuration files,
and content you submit for scanning. TechnoNet processes this data solely to deliver the Service
and does not assert any rights over your data. Scan results generated from your data are also yours.
Feedback: If you provide feedback, suggestions, or ideas about the Service,
TechnoNet may use them freely without obligation or compensation.
7. Not Legal Advice
AuditCore provides Compliance Visibility, not legal advice.
Scan results identify technical gaps between your artefacts and Malaysian regulatory frameworks.
They do not constitute legal opinions, and they do not determine whether any gap constitutes a
violation of any applicable law. TechnoNet is not a law firm and does not practice law.
You should engage a qualified legal counsel or compliance professional to interpret scan results
and determine the appropriate course of action. TechnoNet accepts no liability for decisions made
on the basis of scan results without appropriate legal review.
8. Limitation of Liability
To the maximum extent permitted by Malaysian law:
- The Service is provided on an "as is" and "as available" basis. TechnoNet makes no warranty,
express or implied, that the Service will be uninterrupted, error-free, or that scan results will
be exhaustive or complete.
- TechnoNet's aggregate liability to you for any claim arising from or related to these Terms or
the Service — whether in contract, tort, or otherwise — will not exceed the total fees paid by you
to TechnoNet in the 3 months immediately preceding the claim.
- TechnoNet will not be liable for indirect, incidental, special, consequential, or punitive
damages, including loss of profit, loss of data, or loss of business opportunity, even if advised
of the possibility of such damages.
- These limitations do not exclude liability for death or personal injury caused by negligence,
fraud, or any liability that cannot be excluded under applicable Malaysian law.
9. Data Protection and Privacy
TechnoNet's collection and use of personal data in connection with the Service is governed by
our Privacy Policy, which forms part of these Terms. By using the Service,
you agree to the Privacy Policy. The Privacy Policy also constitutes TechnoNet's Data Processing
Agreement for the purposes of PDPA s.9 (as amended in 2024).
10. Termination
Either party may terminate the account at any time:
- By you: Delete your account from the account settings page. Your data will
be purged within 30 days of account deletion, except billing records which are retained for 7
years as required by Malaysian tax law.
- By TechnoNet: TechnoNet may suspend or terminate your account immediately for
violation of these Terms, non-payment of fees, or conduct that poses a risk to other users or the
platform. TechnoNet will provide notice where possible and where doing so does not compromise
security or legal obligations.
Upon termination, your right to access the Service ceases immediately. Unused scan credits are
forfeited on termination for breach; for customer-initiated cancellations, remaining monthly-allowance
credits are forfeited at end of the billing period, but purchased top-up credits may be refunded
pro-rata at TechnoNet's discretion.
11. Modifications to These Terms
TechnoNet may update these Terms from time to time. Material changes will be notified by email
to registered users at least 14 days before taking effect. The updated Terms will be posted at this
URL with a revised effective date. Continued use of the Service after the effective date of changes
constitutes acceptance of the updated Terms. If you do not agree to a change, you must stop using
the Service and may cancel your account before the change takes effect.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute
arising from or in connection with these Terms — including any question regarding their existence,
validity, or termination — shall be subject to the exclusive jurisdiction of the courts of
Kuala Lumpur, Malaysia.
Prior to initiating legal proceedings, the parties agree to attempt to resolve disputes in good
faith through direct negotiation for a period of not less than 30 days.
13. Severability and Entire Agreement
If any provision of these Terms is found to be invalid or unenforceable under applicable law, that
provision will be modified to the minimum extent necessary to make it valid and enforceable, and the
remaining provisions will continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire
agreement between you and TechnoNet with respect to the Service and supersede all prior agreements,
representations, and understandings.
